By accessing or using any nolimit foundation services (the "Services"), including our AI model, NL credits (usage metering), card, swap platform, and related products, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using our Services under applicable law
  • You will comply with all applicable laws and regulations

3. Service Description

3.1 AI Model

Our AI model provides privacy-focused artificial intelligence services. The model's outputs are generated algorithmically and should not be considered as professional advice.

3.2 NL credits

NL credits (denominated in the $NL unit) are usage credits for metering access to LLM, API, and related platform features. They are not a digital asset for speculation, not an investment product, and do not represent equity or ownership in nolimit foundation.

3.3 Card

The nolimit card is a privacy first payment solution. Card services are subject to availability and compliance with payment network rules.

3.4 Swap

Our swap platform facilitates digital asset conversion. Swaps settle on public networks and are subject to network fees and conditions outside our control.

4. User Responsibilities

You agree to:

  • Provide accurate information when required
  • Maintain the security of your account credentials
  • Not use our Services for illegal activities
  • Not attempt to hack, disrupt, or compromise our Services
  • Not violate any applicable laws or regulations
  • Not engage in market manipulation or fraudulent activities

5. Fees and Payments

Certain Services may require payment of fees. All fees are non-refundable unless otherwise stated. We reserve the right to modify our fee structure with reasonable notice. Public settlement network transactions are subject to network or validator fees, which third-party validators control, not us.

6. Intellectual Property

All content, trademarks, and intellectual property associated with our Services are owned by nolimit foundation or our licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties regarding accuracy, reliability, or availability
  • Warranties that the Services will be uninterrupted or error-free

Digital asset settlements are generally irreversible. We are not responsible for losses due to user error, network issues, or market volatility.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOLIMIT FOUNDATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICES.

9. Indemnification

You agree to indemnify and hold harmless nolimit foundation, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Services or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease.

11. Dispute Resolution

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class actions.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through our platform. Continued use of the Services after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
